Foucault devoted much of the last part of his life to exploring sexuality in societies around the world. In his writing he has given special attention to the amount and importance of sexual discourse and also to the increasing openness regarding sexual diversity.

Through the early years of the twentieth century, the “Regina/Hicklin” test continued to prevail in American courts, but as early as 1913, Judge Learned Hand had already identified crucial flaws in the logic of this obscenity definition. As he observed, if the reference to “minds . . open to immoral influences” referred to children, then adults would be legally limited to reading only the contents of a child’s library. Judge Hand also noted that a work of science or literature could be banned under the ruling for a containing a single instance of obscenity.

Samuel Pepys, the well-to-do London diarist of the seventeenth century, is an example of a man who had sufficient means to obtain pornography. In his celebrated diaries, Pepys scrupulously described everything he did: the good, the noble, the scandalous, and the dishonest, even recording a number of his adulterous seductions, liaisons, and love affairs. In one of his diary entries, Pepys describes purchasing a copy of L’Ecole des filles in 1668 from his regular book dealer. This volume is usually credited with being the first work in the French-language pornographic tradition (DeJean 1993).
